1. About ActionSims

ActionSims is a baseball simulation game that allows users to manage historical baseball teams, play individual games, replay historical seasons, create custom leagues and tournaments, and explore baseball history through simulated gameplay.

ActionSims is currently provided free of charge.

We may introduce additional features, change existing features, or offer optional paid services in the future. Any charges will be clearly disclosed before purchase.

We reserve the right to modify or discontinue any feature at our discretion.

2. User Accounts

You may play certain portions of ActionSims without registering, but an account is required to save gameplay progress and access certain features.

When registering, you agree to provide accurate information and maintain the security of your account credentials.

You are responsible for activity occurring under your account and should notify us if you suspect unauthorized access.

We reserve the right to suspend or terminate accounts that violate these Terms of Service or threaten the security and integrity of ActionSims.

3. Saved Games and Gameplay Data

Registered users may save individual games, seasons, leagues, tournaments, statistics, team configurations, and other gameplay information.

We make reasonable efforts to maintain saved gameplay data. However, we do not guarantee its permanent availability, accuracy, integrity, or recoverability.

Saved data may be lost, corrupted, modified, or deleted because of software updates, database changes, technical failures, security incidents, maintenance, or other circumstances.

Updates to simulation algorithms, statistical calculations, player ratings, historical information, or gameplay mechanics may affect existing saved games and seasons.

We reserve the right to modify or remove gameplay data when reasonably necessary to maintain, improve, or discontinue the service.

4. Service Availability and Discontinuation

ActionSims is an independently operated game provided free of charge. We do not guarantee that the website, game, or any particular feature will remain available indefinitely.

We reserve the right to modify, suspend, restrict, or permanently discontinue ActionSims, in whole or in part, at any time. This includes the right to shut down the website, terminate accounts, discontinue gameplay features, and permanently delete saved gameplay data.

We may provide advance notice of a planned shutdown when reasonably practical. However, advance notice and the opportunity to export saved data cannot be guaranteed, except where required by applicable law.

By using ActionSims, you acknowledge that your saved games, seasons, leagues, tournaments, and other gameplay records may become permanently unavailable if the service is discontinued.

To the fullest extent permitted by applicable law, ActionSims and its operators are not responsible for damages resulting from service interruptions, permanent shutdown, or loss of saved gameplay data.

5. Acceptable Use

ActionSims is intended for personal entertainment and lawful use.

You agree not to attempt to gain unauthorized access to accounts, servers, databases, or administrative functions; deliberately interfere with the website's operation; distribute malicious software; exploit security vulnerabilities; or use automated systems in ways that place an unreasonable burden on our infrastructure.

You may not use ActionSims to engage in unlawful activities or interfere with other users' enjoyment of the service.

We reserve the right to restrict or terminate access when necessary to protect ActionSims, its infrastructure, or its users.

6. Historical Baseball Data and Simulation Accuracy

ActionSims uses historical baseball records, statistical information, and simulation algorithms to recreate baseball games and seasons.

Although we strive for historical accuracy, ActionSims is intended for entertainment. Simulated game results, player performances, managerial decisions, and statistical outcomes are fictional results generated by our software.

We do not guarantee that historical records, player ratings, statistical calculations, or simulated outcomes are complete, error-free, or representative of actual historical performance.

We may correct historical information, modify simulation algorithms, or adjust gameplay mechanics at any time.

7. Intellectual Property

The ActionSims name, original software, simulation algorithms, website design, original written content, and original graphics are owned by ActionSims or their respective rights holders.

Historical baseball statistics, team names, player names, and other factual information may be used for historical reference and simulation purposes.

Certain photographs, illustrations, graphics, and other materials may belong to third-party rights holders and are used under applicable licenses, permissions, or other lawful grounds.

You may use ActionSims for personal, noncommercial entertainment. You may share screenshots, gameplay results, and other representations of your gaming experience for personal or noncommercial purposes, provided you do not misrepresent their origin or imply an official endorsement.

You may not reproduce, redistribute, sell, or commercially exploit proprietary ActionSims software or other protected content without permission or another lawful basis.

Nothing in these Terms restricts rights you may have under applicable copyright law.

8. Baseball Organizations and Trademarks

ActionSims is an independent baseball simulation game.

Unless expressly stated otherwise, ActionSims is not affiliated with, sponsored by, endorsed by, or officially licensed by Major League Baseball, Minor League Baseball, the Major League Baseball Players Association, or any individual professional baseball club.

Historical team names, player names, league names, and other baseball references are used for identification, historical discussion, and simulation purposes.

All trademarks, service marks, and other intellectual property rights remain the property of their respective owners.

9. Historical Photographs and AI-Generated Images

ActionSims may display historical photographs and AI-generated illustrations of baseball stadiums, ballparks, and other baseball-related subjects.

AI-generated images are artistic reconstructions intended to provide a visual representation of historical settings. They should not be interpreted as authentic historical photographs or exact architectural representations.

We make reasonable efforts to depict historical settings accurately, but certain details may be approximate, speculative, or fictional.

Historical photographs and other third-party images remain subject to their respective copyrights, licenses, and other applicable rights.

10. User-Generated Content

If ActionSims allows users to submit content, including comments, custom league descriptions, team names, or other materials, you are responsible for the content you submit.

You agree not to submit unlawful, threatening, harassing, defamatory, or infringing material.

You retain ownership of your original content but grant ActionSims a nonexclusive, worldwide, royalty-free license to host, store, reproduce, and display that content as reasonably necessary to provide and operate the service.

We reserve the right to remove content that violates these Terms or applicable law.

11. Website Maintenance and Updates

We may perform scheduled or unscheduled maintenance, release software updates, modify database structures, or make other changes necessary to maintain and improve ActionSims.

These activities may temporarily interrupt service or affect existing saved games.

We will make reasonable efforts to minimize disruptions, but we do not guarantee uninterrupted availability or compatibility between all versions of the game.

12. Third-Party Websites and Services

ActionSims may contain links to external websites and may rely on hosting or infrastructure providers to operate the service.

We do not control third-party websites and are not responsible for their content, availability, security, or privacy practices.

Your use of external websites is subject to their respective terms and policies.

13. Disclaimer of Warranties

To the fullest extent permitted by applicable law, ACTIONSIMS is provided "as is" and "as available," without warranties of any kind, whether express or implied.

We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the extent permitted by law.

We do not warrant that the service will be uninterrupted, error-free, secure, or permanently available, or that defects will always be corrected.

We make no guarantee regarding the accuracy of historical information, simulation results, or saved gameplay data.

Your use of ACTIONSIMS is at your own risk.

14. Limitation of Liability

To the fullest extent permitted by applicable law, ACTIONSIMS and its operators shall not be liable for indirect, incidental, special, consequential, or exemplary damages arising from your use of or inability to use the service.

This includes damages associated with service interruptions, technical failures, loss of saved games, seasons, leagues, tournaments, statistics, account data, or permanent discontinuation of the service.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited.

15. Account Suspension and Termination

You may stop using ActionSims at any time and request deletion of your account.

We may suspend or terminate your account if you violate these Terms, engage in conduct that threatens the service, or if ActionSims is discontinued.

Upon termination, you may permanently lose access to your saved games, seasons, leagues, tournaments, and other account-related information.

Provisions that by their nature should survive termination, including intellectual property provisions, disclaimers, and limitations of liability, will remain in effect.

16. Changes to These Terms

We may update these Terms of Service to reflect changes to ActionSims, our operating practices, or applicable legal requirements.
